RESOLUTION NO. 22-11

A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS (“CITY”) SETTING A HEARING TO CONSIDER WHETHER STRUCTURES ON PROPERTY COMMONLY KNOWN AS 918 S ELM, MCPHERSON, KANSAS ARE UNSAFE AND/OR DANGEROUS. 

WHEREAS, pursuant to K.S.A. 12-1750, the City of McPherson, Kansas (“City”) may deem structures unsafe and/or dangerous and direct the structures to be repaired or removed and the premises made safe and secure.

WHEREAS, pursuant to Code Section 18-1052, the City Code Enforcement Officer as a designee of the Building Inspector is the enforcing officer for unsafe and/or dangerous structures; and

WHEREAS, the governing body was presented a written statement from the Building Inspector that improvements on property commonly known as 918 S. Elm are unsafe and dangerous. 

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:

After considering the statement of the City Building Inspector and pursuant to relevant City Ordinance and state statutes, the governing body of the City of McPherson, Kansas hereby fixes a hearing on the 9th day of August 2022 at 9 AM at the Commission Room of the Municipal Center, 400 E. Kansas, McPherson, Kansas 67460 to consider whether the house and all other structures on the property legally described as:

BOWKER'S ADDITION, BLOCK 9, Lot 5, SECTION 33 TOWNSHIP 19 RANGE 03, City of McPherson, McPherson County, Kansas and commonly known as 918 South Elm Street, McPherson, Kansas should be deemed unsafe and/or dangerous pursuant to K.S.A. 12-1753 and repaired or removed.  

Notice shall be provided to the owner, owner’s agent, and lien holders of record and any occupant and published all as provided by statute.
