These notices shall satisfy two separate but related procedural requirements for activities to be
undertaken by the The City of McPherson.
REQUEST FOR RELEASE OF FUNDS
On or after July 29th 2022, The City of McPherson will submit a request to the State of Kansas
for the release of Federal funds from the Community Development Block Grant program under
Title I of the Housing and Community Development Act of 1974, as amended (PL 93-383) to
undertake the following project:

Project Name: CDBG Housing Rehabilitation and CDBG Neighborhood Development
Project Type: Housing Rehabilitation and South Walnut Street Reconstruction
Project Location: Avenue A to the North, South Walnut Street on both sides of the street to the
East, West Avenue F to the South if not in the flood zoon or having a Letter of Map Amendment
(LOMA), and railroad tracks to the West. As well as street reconstruction of Walnut Steet from
Avenue A to Avenue D.
Estimated HUD/CDBG Funds: 500,000.00
Estimated Total Project Cost: 1,140,926.00
FINDING OF NO SIGNIFICANT IMPACT
The City of McPherson has determined that the project will have no significant impact on the
human environment. Therefore, an Environmental Impact Statement under the National
Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is
contained in the Environmental Review Record (ERR) on file at City of McPherson, City Hall
400 East Kansas McPherson, KS 67460 and may be examined or copied 8:00 a.m. to 5:00 p.m.
PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to the City of
McPherson. All comments received by 5:00pm July 28th 2022 will be considered by The City
of McPherson prior to authorizing submission of a request for release of funds. Comments
should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of McPherson certifies to the State of Kansas that Thomas Brown in his capacity as
City of McPherson Mayor consents to accept the jurisdiction of the Federal Courts if an action
is brought to enforce responsibilities in relation to the environmental review process and that
these responsibilities have been satisfied. The State of Kansas’s approval of the certification
satisfies its responsibilities under NEPA and related laws and authorities and allows The City of
McPherson to use HUD/CDBG program funds.
OBJECTIONS TO RELEASE OF FUNDS
The State of Kansas will accept objections to its release of funds and the grantee certifications
for a period of 15 days following the anticipated submission date or its actual receipt of the
request (whichever is later) only if they are on one of the following bases: (a) the certification
was not executed by the Certifying Officer of the grantee; (b) the grantee has omitted a step or
failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the
grant recipient or other participants in the development process have committed funds, incurred
costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of
funds by the State of Kansas; or (d) another Federal agency acting pursuant to 40 CFR Part 1504
has submitted a written finding that the project is unsatisfactory from the standpoint of
environmental quality. Objections to the release of funds must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to
the Kansas Department of Commerce, CDBG program, 1000 S.W. Jackson Street, Suite 100,
Topeka, KS 66612. Potential objectors should contact Commerce to verify the actual last day of
the objection period.
